Advocate Pradeep Kumar Yadav has challenged the decision of Allahabad High Court in the Supreme Court. A petition was filed in the Supreme Court against the closure of 5 thousand government schools in Uttar Pradesh. The petition said that more than 3 lakh 50 thousand students will be forced to enroll in expensive private schools.
Although the Supreme Court called it a policy decision of the government, but the hearing has been ready. Apart from this, those schools will also be merged together if there is a river, highway, railway track, drain etc. on the way to a school. It is being said that 445 primary and upper primary schools are to be merged in the capital Lucknow alone.
According to government data, the number of government schools from 2014-15 to 2023-24 has decreased by 8%. While talking about private schools, they have seen an increase of 14.9%.
The petition filed challenged the Allahabad High Court’s decision
The petition filed challenged the decision of Allahabad High Court. The High Court has given the green signal to the merger, dismissing the petition of 51 children of Sitapur. 51 children of Sitapur have filed against the government’s school merge policy. The High Court justified the government’s decision. The court clearly stated in its judgment that they will not interfere in the policy decisions of the government.

This decision is in the interest of children: Allahabad High Court
The court said that this decision is in the interest of children. In such cases, policy decisions cannot be challenged, unless it is unconstitutional or unfortunate. In the petition filed, the order issued by the Department of Basic Education on June 16 was challenged, in which the primary schools with low student numbers were asked to merge the high FIR or composite schools.
Demand for cancellation of order stating the right to education law
The petition filed has demanded the cancellation of the order, calling it a violation of the Right to Education Act. Explain that the Uttar Pradesh government has decided that primary and upper primary schools with less than 50 students in the state will be merged into large schools. This decision will affect more than 5000 schools in the entire state.
